Important: Your Consumer Rights

Nothing in these Terms of Service excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Forniture (ABN: 77 659 076 516) operates through forniture.com.au, providing factory-direct furniture import services from Foshan, China to Melbourne, Australia. By using this website, you agree to these terms.

2. Product Descriptions

  • We sell designer-style furniture manufactured in Foshan factories; these are not branded/licensed products
  • Product images are for reference only. Actual products may vary slightly due to material batches and monitor colour differences
  • Product dimensions are as specified on the detail page, with a manufacturing tolerance of +/- 2cm
  • All prices are in Australian Dollars (AUD) and include GST

3. Orders and Payment

  • After placing an order, we will send an order confirmation; the contract is formed upon confirmation
  • Payment is securely processed through Stripe, supporting Visa, Mastercard and other major credit cards
  • Standard payment terms: 60% deposit at order, 40% balance before delivery
  • Prices may change due to exchange rate fluctuations or shipping cost adjustments; the price at the time of order placement applies

4. Delivery

  • Standard delivery time is 8-10 weeks (including production, sea freight, customs clearance, and local delivery)
  • Delivery area covers Melbourne Metropolitan area
  • Remote areas may incur additional delivery charges; you will be notified before ordering
  • Delivery times are estimates and may be delayed due to weather, customs, shipping schedules, or other factors beyond our control
  • We will notify you of your order status at each key milestone

5. Quality Guarantee and Warranty

  • All furniture is inspected before shipping
  • 3-day satisfaction guarantee: if not satisfied within 3 days of delivery, we offer a 50% refund with free pickup (see Returns Policy)
  • 5-year frame warranty for structural issues (see Warranty Policy)
  • 12-month warranty on leather and fabric materials (excluding normal wear)
  • Warranty does not cover damage caused by misuse, neglect, or natural ageing

These warranties are in addition to, and do not replace, your statutory rights under the Australian Consumer Law.

6. Returns and Refunds

Please refer to our detailed Return & Refund Policy for full terms. Your rights under the Australian Consumer Law are not affected by our returns policy.

7. Intellectual Property

All content on this website (text, images, design, code) is owned by Forniture or used under licence. Reproduction, distribution, or commercial use without written permission is prohibited.

8. Limitation of Liability

Subject to the Australian Consumer Law rights preserved above:

  • We are not liable for delays or losses caused by force majeure events (natural disasters, war, pandemics, etc.)
  • The website may be temporarily unavailable due to maintenance or technical issues
  • Third-party links are provided for reference only; we are not responsible for their content

To the extent permitted by law, our total liability to you for any claim arising from or in connection with these terms shall not exceed the amount you paid for the relevant product or service.

9. Dispute Resolution

If a dispute arises, we encourage you to first contact us directly at [email protected] so we can attempt to resolve the matter informally.

If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation through the Victorian Small Business Commission (VSBC) or another agreed mediation service before commencing legal proceedings.

Nothing in this clause prevents you from lodging a complaint with the ACCC, Consumer Affairs Victoria, or seeking urgent injunctive relief from a court.

10. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. The courts of Victoria shall have non-exclusive jurisdiction over any disputes.

11. Changes to Terms

We may update these terms from time to time. Material changes will be notified via email or a prominent notice on the website. Continued use of the website after changes constitutes acceptance of the updated terms.
